Secure Data Recovery Services services are provided "as is," without warranty of any kind, either expressed or implied, including without limitation to any warranty for information, services, or products provided through or in connection with the service, including without limitation to any results obtained through the service. Specifically, Secure Data Recovery Services disclaims any and all warranties, including without limitation:

1) Any warranties concerning the availability, accuracy, or content of information, products, or services; and

2) That you agree that use of the service is entirely at your own risk.

This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft, destruction, unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action. You specifically acknowledge that Secure Data Recovery Services is not liable for the defamatory, offensive, or illegal conduct of other users or third parties and that the risk of injury from the foregoing is entirely your responsibility.

Secure Data Recovery Services, its owner(s), hosting company, or anyone else affiliated in any way to Secure Data Recovery Services shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of use of the service or inability to gain access to or use the service or out of any breach of any warranty. You hereby acknowledge that the provisions of this section shall apply to all content on the service.

You agree to indemnify and hold Secure Data Recovery Services, its owner(s), and any of its affiliates harmless from any dispute which may arise from a breach of terms of this agreement. You agree to hold Secure Data Recovery Services harmless from any claims and expenses, including reasonable attorney's fees and court costs, related to customer's violation of this agreement, including the terms of service or any content placed on the service by you.

Please Note: If a customer hard drive and/or media has a mechanical issue, Secure Data Recovery Services reserves the right to send out the customer media for an extensive repair to our secure Los Angeles, California facility and the customer is fully responsible for the $25.00 shipping and handling fee for the return of the drive Please note that if the client does not contact Secure Data Recovery Services within 30 days Secure Data Recovery Services reserves the right to properly dispose of the media that is sent in. Secure Data Recovery reserves the right to dispose of external hard drive enclosures during the diagnostics process, in order to insure the fastest turn around time on the recovery.

Secure Data Recovery is not responsible for loss of profit or any direct, indirect, special, incidental, or consequential damage occurring during or after data recovery. Secure Data Recovery will also not be held responsible or liable for any damage to computers, macs, laptops or any other hardware aside from hard drives left in our possession.

WE HAVE THE RIGHT TO DISTRIBUTE DRIVES BETWEEN WORK STATIONS AND/OR DATA RECOVERY LAB LOCATIONS DEPENDING ON FAILURE TYPES. IN ORDER TO CANCEL A WORK ORDER WE REQUEST A 48 HOUR NOTIFICATION NOTICE TO RETURN THE MEDIA TO THE OWNER.
